California approved legislation that provides victims of spyware the ability to collect up to a $1,000 in damages. I don’t see how this can be enforceable or even reasonable to enforce. Who is going to track down spyware offenders? How will they be tracked down? What happens if the offending spyware maker is in another country? Are the authorities going to fly to the other side of the planet to track down spyware makers? How are they going to enforce the fines upon a person in another country?

A recent survey by Earthlink and Webroot found that 90% of PCs are infested with the surreptitious software and that, on average, each one is harbouring 28 separate spyware programs.

Has Governor Schwarzenegger turned the finances of California around so much that they can afford to enforce such a law?
